What Clayton professional firms need from IT

Professional firms hold other people's confidential information, and that raises the bar for how email, files and payments are protected.

  • Law firms. Missouri revised the comment to Rule 4-1.1 in 2017 to say that competent lawyers keep up with the benefits and risks of relevant technology, and Rule 4-1.6 requires reasonable efforts to prevent unauthorized access to client information. In practice that means multi-factor authentication on email and document systems, encrypted laptops and a tested way to recover files after ransomware.
  • Accounting and tax practices. Tax preparers fall under the FTC Safeguards Rule. Since May 13, 2024, a breach of unencrypted information about 500 or more customers must be reported to the FTC within 30 days of discovery. The IRS also expects tax professionals to keep a written information security plan, and a risk assessment shows which controls behind that plan are missing.
  • Payment and wire fraud. Firms that move client funds are common targets for business email compromise, where an attacker poses as a partner or client to redirect a payment. Email authentication (SPF, DKIM and DMARC), call-back rules for payment changes and short, regular staff training reduce that risk. Read how these emails work.
  • Missouri breach notification. Missouri law (RSMo 407.1500) requires notice to affected residents after a breach of personal information, and notice to the Attorney General and the consumer reporting agencies when more than 1,000 residents are notified at once. Knowing what data you hold and where it lives makes that decision faster.
